QUESTION: We are wondering what other agencies are doing regarding paying people who are suspended for allegations of abuse, neglect or exploitation. Do they pay for all hours scheduled even if the person has agreed to work hours beyond their normal schedule? Do they pay whether or not the allegation is substantiated? Also, what is the average length of investigations completed and how many days are people typically paid while suspended? When an employee is placed on Administrative Leave for an investigation, if the allegation is unsubstantiated, we pay admin for scheduled shifts missed, up to a maximum of 8 hours a day/40 hours a week when combined with all other hours for that employee for that time frame. If the allegation is substantiated, the employee receives no admin pay for time on leave and cannot use any accrued PTO. Usually, a substantiated allegation leads to termination. This is all explained when the employee is placed on leave and they are given it in writing as well. *** During a suspension the staff are paid. The investigation typically takes 3-5 days occasionally longer. The staff are paid their normal scheduled hours. *** We pay the individual “their regularly scheduled work hours” missed while the investigation ensues for allegations of abuse, neglect, and exploitation. Generally, investigations are completed in a 24-48 hour window…but, no more than 72 hours. *** For our agency, employees who are suspected of serious misconduct, or have alleged involvement in abuse or neglect, may be suspended with pay in situations where an investigation is required. Suspended employees will be paid for regularly scheduled work days during the investigation period up to five (5) days. *** Our agency does not pay an employee who is suspended from duties under these circumstances. Only if the results of the investigation allow the employee to return to duty will the employee receive back pay for the time of suspension.
