QUESTION: How do employment centers have their clients classified? As independent contractors or employees? Tangram’s Employment Consultants are classified as non-exempt hourly employees. The clients in our sheltered work program are employees. Their hours are kept under 30/week. Employees DSI has all clients in their payroll data base and syncs into their Provide System, which is their client and staff database for admin and program tracking. Being set up this way allows several reports to be used whether there is actual pay or not. Employees, with a special numbering system is how we classify our clients. We classify them as independent contractors. A couple of years ago an investigator with the U.S. Department of Labor informed us that the consumers are considered “employees” in the eyes of the DOL.
